美国大队户外活动出行免责声明活动发起格式

为了规范越野e族美国大队活动出行，丰富越野e族美国大队族友们的业余生活，使每一位参与者的权利、义务、责任得到明确，请参与者仔细阅读本声明，自愿选择是否参加。特发此声明，以备越野e族美国大队活动时之需。 <?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /><o:p></o:p>
 
越野e族美国大队活动宗旨是以“安全、环保、自助、自律、平等”为宗旨。所有越野e族美国大队户外活动均为，自发性的、具有发扬团结互助、助人为乐的精神的族友聚会，以非商业自助性质的旅游为目的.    所有参与者按照“尽力救助，风险自担”的原则参加越野e族美国大队活动，在力所能及的范围内尽量给予他人便利和帮助。但任何便利和帮助的给予并不构成法律上的义务，更不构成对其他参与者损失或责任在法律上分担的根据；
 
 越野e族美国大队，是一个非盈利性网络组织。所有活动非赢利性质自助出行活动，越野e族美国大队活动的参与者均为非专职工作人员。所有活动没有实质的发起人、联系人、组织人，所有活动开展提出建议或意见者也不被视作为组织人、发起人和联系人，没有任何人是专职的工作人员。 
 
越野e族美国大队活动的发起、联系、是在参与者自愿参加与退出、风险与责任自负的原则上组成的。均为族友之间自发相约而成，版主和热心族友有义务提供无偿相互之间的帮助。 <o:p></o:p>

越野e族美国大队的一切活动都是在美立坚和众国相关法律的，合法的范畴内进行的，一切因参加越野e族美国大队活动者直接或间接引起的法律责任将自行独立承担. 如恶意侵犯他人或其它涉及犯罪行为，则不在此免责范围内，必须承担相应的法律责任。

一切参加越野e族美国大队活动的车辆、设施以及相关装备属于参加者自己所有，车主或驾驶员必须持有合法有效驾驶证、保险、车主证等参加越野e族美国大队活动，参加越野e族美国大队活动者请购买相应的人身损害保险。在参与越野e族 美国大队活动期间所产生的一切安全风险及责任由参加越野e族美国大队活动者自行独立承担. 
 
越野e族美国大队户外活动会有不可预见的、潜在的危险性，因在道路行驶、旅游过程、食宿、自身身体健康、自然灾害等等，不可抗力等不可预测因素，均有可能造成对自己生命财产的伤害和损失，参加者应提高安全意识。参加越野e族美国大队活动者应当积极主动的购买保险，降低损失。如在活动中突发意外事件或人身伤害，由保险公司和自己负责赔偿，不牵扯参与越野e族美国大队活动的其他人员。其他参与者和协调者不承担任何法律责任和经济赔偿责任；<?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /><o:p></o:p>

凡报名参加越野e族美国大队活动者年满18岁者均视为具有完全民事行为能力人；凡报名参加者未满18周岁的，由其活动时的监护人负责其全部行为安全。 在活动中，有任何意外，均与越野e族美国大队无关，特此免责申明。<o:p></o:p></o:p>

代他人报名者，被代报名参加越野e族美国大队活动者，如遇意外事件或遭受人身损害，如同样适用于此免责声明所有条款。报名并乘行人员视同已经接受此免责声明所有条款，不再单独签定协议。自报名之时表示该约定生效到活动结束自动失效。受损害人依据法律规定和本声明依法解决。

越野e族美国大队活动为自由组合性质，活动发起者及组织者不安排搭乘，搭乘者与驾驶者对于双方权利义务自行协商。但若期间一旦发生交通意外，同车搭乘者认可只在该车已投保的保险范围内接受赔偿，不再另行向该车主人或司机或活动组织者等索赔，双方另有协议的除外。一但出现事故，活动的参与者有积极主动的组织实施救援工作的义务，活动中的任何非事故当事人将不承担事故任何责任和经济责任。 <o:p></o:p>
 
凡参加越野e族美国大队活动的驾驶员将竭尽安全驾驶之原则，亦不能保证不发生交通意外或事故。如发生交通意外或事故造成搭车人伤亡的，搭车人自愿放弃向本车辆所有权人或者驾驶员索取赔偿和追究法律责任的权利，自己负责治疗和处理交通事故带来的伤害。考虑到有一定的危险性，强烈建议参加者自行购买意外伤害保险。

所有参与者对越野e族美国大队户外活动及搭乘越野e族 美国大队活动者车辆的参与者都是完全自愿的，参与者对本声明条款的含义及相关法律后果已全部通晓并充分理解后接受本声明。

而且建议以后多弄点洋文，一来兄弟们多了个学习洋文得实战机会，二来有符合“usa team"的文化特色，三来可以让老外也更直接地了解我们在玩什么，和美国乃至世界打开一个交流窗口，意义非凡。

一、做为一个在海外的中国人！英文只是生存技能之一，而不是为了在全国的XDJM面前炫耀！想学实战英文，光看没用的，还需要多多跟老外面对面交流！
二、感谢，SIESO哥指点的USA TEAM文化！但必定是具有中国人特色的美国文化！但面是全国的XDJM我们还是要低调低调！因为你们可是我们最坚强的后盾啊！！！
三、通常都是老外来搭讪在海外玩越野车的中国人！！至于交流窗口，还需要SIESO哥以版主之名跟总部交涉开设中英双语网站，SIESO哥为族人打开世界交流之窗，影响深远啊！！！
